1. Introduction and Definitions

This disclaimer outlines the terms of use for the Steel Genie software developed by Steel Genie, LLC. Steel Genie is a software application designed to automate steel quantity take-off and modeling processes. It aims to facilitate tasks such as quantity estimation, modeling, IFC file generation, and related data management for steel structure projects.

Definitions within this disclaimer: "Software": The Steel Genie application and all associated components. "User": Any individual or legal entity using Steel Genie.

2. Purpose of the Software

Steel Genie is designed to automatically extract section information from drawing files in steel structural drawings, generate 3D models, and convert these models into analyzable data. Its purpose is to improve speed, efficiency, and project clarity.

Steel Genie does not make engineering decisions; it is intended solely to provide information and assist in workflows. The software outputs are supportive and must be reviewed and approved by a licensed engineer during implementation.

3. Data Processing and Privacy

Steel Genie may collect and process user-provided data such as project files, structural drawings, and related metadata to perform core software functions, improve software performance, quality, and user experience, and support security, auditing, and troubleshooting activities. User data is stored securely and is not shared with third parties except as required by law or for essential service operations under confidentiality agreements. All project data remains the property of the user, and Steel Genie, LLC claims no ownership of user-generated content.

Users may request access to or deletion of their data by contacting info@steelgenie.com. Data processing is conducted in compliance with applicable privacy laws, including GDPR where relevant.

4. Accuracy of Calculations and Modeling

The accuracy of Steel Genie outputs depends on the quality of the source drawings. Clear and organized drawings yield higher efficiency; however, 100% accuracy is not guaranteed. The software does not perform steel section calculations; it only collects and provides data.

Connection calculations are performed based on user input and in accordance with AISC specifications; however, the user is responsible for verifying all results and making necessary adjustments. The data provided by the software is for assistance only, and Steel Genie or its developer cannot be held liable for any losses resulting from inaccuracies or omissions.

5. Responsibility for Engineering Decisions

Steel Genie is not designed to make engineering decisions. It only provides data collection, modeling, and supportive calculations. Final approvals and engineering decisions must be made by estimators, and calculation design decisions must be made by licensed engineers. The user is solely responsible for independently verifying the information provided by the software and conducting technical evaluations.

6. Disclaimer of Warranties

Steel Genie is provided "as is," without any guarantees regarding performance, error-free operation, or uninterrupted functionality. To the maximum extent permitted by law, Steel Genie, LLC disclaims all implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement of third-party rights. The user assumes all risks and is responsible for determining the suitability of the software for their intended use.

7. Limitation of Liability

Steel Genie and its developer shall not be liable for any direct, indirect, or consequential damages arising from the use or inability to use the software, including but not limited to data loss, business interruption, or loss of profits. To the extent permitted by applicable law, the total liability of Steel Genie is zero (0), with no obligation for any payment or refund.

8. Data and File Compatibility

Steel Genie supports data export in specific formats (IFC, Excel, PDF), but compatibility with other software is not guaranteed. The user is responsible for any issues related to file conversion, data loss, or formatting errors. It is the user's obligation to perform verification and compatibility testing.

9. Third-Party Integrations

Steel Genie provides data integration with software such as SDS/2, Tekla, and SAP2000 via the IFC format; however, flawless operation of these integrations is not guaranteed. The developer assumes no responsibility for the functionality of third-party software or any resulting data loss.

10. User Responsibilities

The user agrees to use the software only for its intended purpose. It is the user's responsibility to provide accurate input data, independently verify outputs, and comply with licensing terms.

The user is fully responsible for any consequences arising from misuse, incorrect data entry, or license violations. Steel Genie may not be copied or reproduced without authorization.

11. Updates and Right to Modify

Steel Genie, LLC reserves the right to modify the software, add new features, or remove existing features at any time. Changes, including those related to pricing policies, may be implemented without prior notice. The developer does not guarantee that the software will be supported for any specific period.

12. Governing Law and Jurisdiction

This disclaimer and any disputes related to the use of the software are governed by the laws of South Carolina, USA. The exclusive jurisdiction lies in South Carolina courts. The user is responsible for complying with applicable laws in their own country.
